Uniform Code for Marketing Practices

Why in News?
The Uniform Code for Pharmaceutical Marketing Practices (UCPMP) is a regulatory framework issued by the Department of Pharmaceuticals (DoP) to enforce strict ethical standards and transparency in the marketing of pharmaceutical drugs and medical devices.

Scope and Applicability
  • Target Entities: The code strictly applies to pharmaceutical companies, medical device manufacturers, medical representatives (MRs), distributors, wholesalers, retailers, and pharma industry associations.
  • Pharma and Devices: While UCPMP governs drugs, a sister framework called the Uniform Code for Marketing Practices in Medical Devices (UCMPMD) covers the medical device sector.
Strict Bans on Doctor Inducements
  • No Gifts: Pharma companies and their agents are strictly prohibited from offering, promising, or supplying gifts, pecuniary advantages, or benefits in kind to healthcare professionals (HCPs) or their families.
  • No Travel and Vacations: Extending domestic or international travel facilities—such as air tickets, rail tickets, cruise packages, or paid vacations—to HCPs and their families is completely banned.
  • Speaker Exceptions: Travel and hospitality can only be covered if the medical professional is an active speaker at a conference or workshop.
Strict Rules for Drug Samples
  • Prescription Restriction: Free samples can only be handed out to individuals fully qualified to prescribe the drug.
  • Caps and Limits: A healthcare professional can receive a maximum of 12 sample packs per year.
  • Caps on Sample Value: The total financial value of distributed samples must not exceed 2% of the company's annual domestic sales.
Regulation of Drug Claims & Advertisements
  • Marketing Approvals: No pharmaceutical product can be promoted or advertised before receiving formal marketing approval from the competent authorities.
  • Restriction on "Safe" and "New": The word "safe" cannot be used without qualification, and companies cannot claim a drug has zero side effects. The word "new" cannot be used for any drug that has been available in India for over a year.
  • Endorsement Restrictions: Using names or photographs of healthcare professionals in promotional media or public advertisements is entirely prohibited.
Enforcement and Accountability
  • CEO Accountability: The Chief Executive Officer (CEO) of a pharmaceutical company is directly held responsible for compliance. CEOs must submit a mandatory annual self-declaration confirming adherence to the code.
  • Ethics Committee Setup: All pharma associations must set up a 3-to-5 member Ethics Committee for Pharmaceutical Marketing Practices (ECPMP) to handle violations.
  • Penalties: Established breaches can lead to recovering the value of unethically gifted items, official suspension or expulsion from the industry association, or direct referral to government agencies for statutory legal action.
